Invasive measures, as special investigative measures are defined, are ante delictum measures. They are applied only in situations in which the evidence cannot be obtained by conventional methods, and are needed for the smooth conduct of criminal proceedings. The financial means for the application of these invasive measures for the needs of defence and security are allocated with a budget by the legislative authority. The main hypothesis of this paper states that: supervision over the application and financing of the implementation (...) of special investigative measures has a positive impact / or is in direct correlation with the effective construction/development and functioning of the security-defence system, especially from the aspect of the principles of: good governance, transparency, accountability, proportionality, and efficient application of financial resources. Starting from the indicated hypothesis, the research in the paper is based on two variables: independent variable, i.e., the supervision over the application and financing of the implementation of the special investigative measures, and a dependent variable, i.e., the effective development and proper and efficient functioning of the security-defence system. From a methodological point of view, the paper uses a combined approach of qualitative and quantitative analysis, through research, measurement, and comparison of: adopted international standards regarding the application of special investigative measures, the regulations in the Macedonian normative framework, the content of the instructions and the implementation manuals of the special investigative measures by the relevant institutions in the Macedonian society. The right to be forgotten is a proposed legal response to the potential harms caused by easy digital access to information from one's past, including those to moral autonomy. While the future of these proposed laws is unclear, they attempt to respond to the new problem of increased ease of access to old personal information. These laws may flounder in the face of other rights and interests, but the social values related to moral autonomy they seek to preserve should be (...) promoted in the form of widespread ethical information practices: information stewardship. Code, norms, markets, and laws are analyzed as possible mechanisms for fostering information stewardship. Two terms, student privacy and Massive Open Online Courses, have received a significant amount of attention recently. Both represent interesting sites of change in entrenched structures, one educational and one legal. MOOCs represent something college courses have never been able to provide: universal access. Universities not wanting to miss the MOOC wave have started to build MOOC courses and integrate them into the university system in various ways. However, the design and scale of university MOOCs create tension for privacy laws (...) intended to regulate information practices exercised by educational institutions. Are MOOCs part of the educational institutions these laws and policies aim to regulate? Are MOOC users students whose data are protected by aforementioned laws and policies? Many university researchers and faculty members are asked to participate as designers and instructors in MOOCs but may not know how to approach the issues proposed. While recent scholarship has addressed the disruptive nature of MOOCs, student privacy generally, and data privacy in the K-12 system, we provide an in-depth description and analysis of the MOOC phenomenon and the privacy laws and policies that guide and regulate educational institutions today. We offer privacy case studies of three major MOOC providers active in the market today to reveal inconsistencies among MOOC platform and the level and type of legal uncertainty surrounding them. Finally, we provide a list of organizational questions to pose internally to navigate the uncertainty presented to university MOOC teams. (shrink)

The demolition of Sophiatown, Cato Manor, District Six and other areas under the apartheid regime hugely impacted the socio-economic lives of various South Africans. The classification of South African cosmopolitan townships as slums according to the Slums Act of 1934, and the ambitions of achieving social segregation, resulted in the geographical separation of races facilitated by the Group Areas Act of 1950. The act legally justified the forced removal of Indian families from Sophiatown. Then, they were temporarily placed in a (...) military base next to Lenasia. Through the use of oral interviews, this article interrogates the unknown history of the Indian families in their transitional period from Sophiatown to Ammunition Depot 91. Furthermore, the article sheds light on their untold experiences; particularly on the arrival of Indian families in the military camp, their living conditions, health-related matters, the utilisation of coping mechanisms such as religion and recreational activities, perceptions about their stay, effects on transportation and their general experiences in the transition camp. The article accentuates the rapid nature of these removals particularly in Sophiatown which resulted in the lack of adequate alternative accommodation for the Indian residents.Contribution: The article offers fresh perspectives for deeper interrogation of the consequences of forced removals in apartheid South Africa, by reflecting on the memories and lived experiences of interviewees in a case study that has hitherto not been addressed by social historians. As a normative concept, consent can perform the “moral magic” of transforming the moral relationship between two parties, rendering permissible otherwise impermissible actions. Yet, as a governance mechanism for achieving ethical data practices, consent has become strained—and AI has played no small part in its contentious state. In this chapter we will describe how consent has become such a controversial component of data protection as artificial intelligence systems have proliferated in our everyday lives, highlighting five distinct issues. We will then (...) lay out what we call consent’s “moral core,” which emphasizes five elements for meaningful consent. We next apply the moral core to AI systems, finding meaningful consent viable within a particular digital landscape. Finally, we discuss the forces driving some commentators away from individual consent and whether meaningful consent has a future in a smart world. (shrink)

Izobraževanje ne pomeni le nabiranja splošnega znanja ali podlage za študij. Pouk klasičnih jezikov daje mladim izobraževalno širino in je priložnost za jezikovno ozaveščanje. Latinščina je jezik, ki povezuje in ne ločuje, jezik, ki pripada vsakomur v enaki meri in je od vsakogar enako oddaljen. Ni ne moj ne tvoj, ni od nikogar in je od vseh.

Leta 1869 rojeni Josip Pipenbacher je po končani gimnaziji v Mariboru in nato v Ljubljani, kjer je maturiral, na Dunaju študiral klasično filologijo in tam l. 1895 tudi doktoriral kot drugi slovenski doktor klasične filologije (za Franom Detelo). Po opravljenem učiteljskem izpitu je poučeval na II. državni gimnaziji v Ljubljani, na gimnaziji v Novem mestu in nato znova na II. državni gimnaziji v Ljubljani, ki jo je v obdobju od l. 1921 do upokojitve l. 1928 vodil kot direktor. Namen pričujoče raziskave je prikazati do sedaj zanemarjeno vlogo češkoslovaških slavistov pri oblikovanju Parry-Lordove teorije ustnega pesništva. Potek predstavlja v obliki zgodbe o pristnem odkritju, ki izhaja iz določenega znanstvenega okolja (Antoine Meillet, praški lingvistični krožek itd.). Glavne vloge v njej igrajo Matija Murko, ustanovitelj češkoslovaške slavistike Roman Jakobson in nekateri drugi raziskovalci. Največ pozornosti članek posveča Murkovim in Parryjevim znanstveno-raziskovalnim strategijam, ki sta jih uporabljala med potovanji na Balkan leta 1930, in jih primerja. Članek razkriva tudi določene povezave (...) med Murkom in Lordom, ter nekatere njihove dokaze, ki do sedaj še niso bili objavljeni. (shrink)

För att kunna känna igen liv när vi hittar det och för att veta hur vi skall leta behöver vi ha en uppfattning om vad liv är. Att försöka konstruera en definition av liv hjälper oss också att formulera våra tankar kring vad liv är. De flesta av oss har nog en intuitiv uppfattning av vad liv är, och kan i de flesta situationer utan problem skilja ut vad som är levande från vad som inte är det. Det finns (...) dock situationer när det inte är fullt så enkelt. Man är till exempel inte överens om huruvida virus är liv. Virus kan föröka sig och genomgår evolution men de har ingen egen metabolism vilket många hävdar är en nödvändig egenskap för att vara levande. Numera finns det också datorprogram som har vissa egenskaper gemensamma med sådant som vi normalt kallar liv. De kan till exempel föröka sig och genomgå en slags evolution. Däremot är de inte uppbyggda av DNA, och dessutom är de ju tillverkade av oss. Trots detta finns det de som vill hävda att datorprogram kan vara levande. Å andra sidan finns det desto fler som förnekar det. Många förnekar också att levande datorprogram alls är möjligt. De som gör det kan till exempel hävda att liv måste ha en viss form av kemisk bas eller vara ett resultat av naturligt urval i motsats till urval baserat på regler som vi människor har konstruerat. När man diskuterar utomjordiskt liv så blir det ofta ännu svårare att avgöra vad som är levande än när vi diskuterar liv här på jorden. Utomjordiskt liv kommer förmodligen att vara väldigt olikt det vi normalt kallar liv men någonting bör det ju ha gemensamt med livet på jorden för att det skall vara befogat att använda beteckningen liv om båda. När man letar efter liv i extrema miljöer här på jorden, och i ännu högre grad när man letar efter liv på andra himlakroppar, är det av avgörande betydelse att man har någon slags uppfattning om vad liv är. Det finns framför allt två skäl till det. Det ena är att man behöver kunna avgöra om det man hittar är liv. Det andra är att vi behöver bestämma oss för hur och var vi skall leta (resurserna för att leta efter liv är ju inte obegränsade). Man behöver till exempel välja rätt slags instrument som reagerar på rätt saker. För att kunna göra det behöver man veta vilka egenskaper man skall leta efter, det vill säga man behöver veta vad liv är. (shrink)

Kljub kratki vladavini je Julijan izpeljal vrsto pomembnih reform, usmerjenih v različne vidike javnega življenja, vključno z upravljanjem provinc. Članek se osredotoča na njegove upravne dejavnosti v Iliriku, kjer je leta 361 po Kr. bival med kampanjo proti Konstanciju II. Med­tem ko se je Julijan med kampanjo soočal z neposrednimi taktičnimi težavami, je v (...) Iliriku opravljal cesarske upravne naloge, kot poročata zgodovinar Amijan Marcelin in panegirist Klavdij Mamertin. Alfred Edward Housman (1859–1936), ki je kasneje postal angleški pesnik in eden največjih filologov svojega časa, je svoj zafrkantski »fragment« objavil pri triindvajsetih, leta 1883, v reviji Bromsgrovian. Revijo je izdajala Bromsgrove School, kjer se je šolal kot najstnik (1870–77); na šolo, ki je prva prepoznala njegov jezikovni in pesniški talent, se je za kratek čas (1881–82) vrnil kot pomožni učitelj po ne­pričakovanem študijskem porazu na Oxfordu. Kot ugotavlja Ralph Marcellino, ni naključje, da besedilo paro­dira predvsem Ajshila, ki je (...) bil Housmanov najljubši pesnik. V njem odzvanja Oresteja, zlasti drami Agamemnon in Prinašalke pitnih darov, verjetno zato, ker so ju dijaki na šoli, kjer je poučeval, pri pouku največ brali. Prav ta ciljna publika je znala ceniti norčevanje iz retoričnih figur ter sintaktičnih konstrukcij, ki jim jih je njihov pomožni učitelj vbijal v glavo. (shrink)

Liv är ett centralt begrepp inom många forskningsområden, exempelvis inom biologi, astrobiologi, kemi och medicin, såväl som inom juridik, teologi och filosofi. Liv är också ett centralt tema i konsten. Det behandlas och begrundas i åtskilliga konstverk, i dikt, roman och film. Hur vi skall förstå, värdera och skydda livet, är oerhört fundamentala frågor. I framtiden kommer dessa frågor att bli än svårare och om möjligt ännu viktigare. Forskargrupper från hela världen arbetar idag med att skapa liv i laboratoriet, (...) class='Hi'>leta efter liv i rymden och förse maskiner med egenskaper som tidigare bara har varit förunnade levande varelser, och utvecklingen går fort. Det är viktigt att vi samtidigt funderar över de utmaningar som detta innebär. Det kommer att ta tid att hitta sätt att leva i en värld där liv finns i former vi idag knappt kan föreställa oss och där gränsen mellan levande varelser och maskiner blir alltmer suddig. De beslut vi fattar idag kommer också att påverka utvecklingen inom samhälle, forskning och utveckling under lång tid framöver. -/- Den här boken är ett resultat av ett tvärvetenskapligt projekt vid Pufendorfinstitutet, Lunds universitet. Znano je, da so negativne velikosti svojo legitimnost od svojega nastanka dalje dobile skozi to, da so bile interpretirane kot dolg. S pretvorbo matematike v prirodoslovje pa je ta interpretacija postala nezadostna. Kantov spis iz leta 1763 o negativnih velikosti predstavlja poskus, da se po vzoru na Eulerjev argument o neizogibnosti iz dela Réflexions sur l'espace et le temps pokaže realnost negativnih velikosti izhajajoč iz tretjega Newtonovega zakona akcije in reakcije. Kantov pojem realne zoperstavljenosti skuša dotedanjo interpretacijo – dolg, (...) spraviti z novo – silo. V tekstu nas zanima težava, ki pri tem nastopi: potlačitev paradoksa negativnih velikosti, ki ga je lahko interpretativno zadovoljil le dolg. Drugače rečeno, paradoksna lastnost negativnih velikosti, ki jo je lahko za realno naredil dolg kot družbeni objekt, postane glavna prepreka za njihovo fizikalno intepretacijo. (shrink)

Dvorec Jelšingrad (Erlachstein), ki se nahaja na severozahodnem obrobju Šmarja pri Jelšah, je bil v sredini 19. stoletja deležen prenove vzhodnega dela stavbe, interierjev in parka po vzorih mavrske in orientalske arhitekture. Za novo eksotično podobo je bil zaslužen tedanji lastnik Rudolf Oskar Gödel-Lannoy (1814–1883), ki je med svojo dolgoletno diplomatsko kariero v Egiptu, na Bližnjem vzhodu in Balkanu načrtno zbiral antikvitete. Ob vrnitvi v domovino jih je v svojem dvorcu razstavil v treh novo nastalih orientalskih dvoranah, kar se v (...) sočasnih virih omenja kot “orientalni muzej”. Iz popisa predmetov, ki so jih leta 1943 v dvorcu zasegli Nemci in prenesli v Pokrajinski muzej Maribor, je razvidno, da je Lannoyjeva zbirka starin vključevala številne predmete iz starega Egipta, Mezopotamije, Grčije in Rima. Z izjemo staroegipčanskega fragmenta Merimosejevega sarkofaga iz 18. dinastije, ki ga danes hranijo v Narodnem muzeju v Pragi, v dosedanjih raziskavah vsebina Lannoyjevih starinoslovnih zbirk še ni bila deležna strokovne pozornosti. Pričujoči prispevek se osredotoča na jelšingrajsko zbirko mezopotamskih predmetov, tj. cilindričnih pečatov, pečatnih kamnov, živalskih amuletov in glinenega stožca kralja Gudea iz Lagaša, ki jih danes hranijo v depoju arheološke zbirke Univerzalnega muzeja Joanneum v Gradcu. V prvi polovici 18. stoletja je bila objavljena serija devetih oziroma desetih latinskih tiskov z naslovom Lakonsko ogledalo Evrope (Laconicum Europae speculum). Podobe z napisi je zasnoval Paul Decker mlajši (1685-1742), Johann Wolfgang Baumgartner (1709-1761) je postavil le tisk za Nizozemca, same bakroreze so izdelali različni bakrorezci (Christian Friedrich Lottes, Johann Georg Pinz, Philipp Andreas Kilian, Andreas Hoffer), uredil in izdal pa jih je Martin Engelbrecht (1684–1756) v Augsburgu okrog leta 1730. Celotni naslov je daljši, Lakonsko ogledalo Evrope, v (...) katerem je brez predsodkov, posmehovanja ali zaničevanja predstavljenih njenih devet posebej uglednih narodov in ljudstev, ki se v določenih lastnostih in znamenjih razlikujejo, vse zaradi radovednosti in zabave (Laconicum Europae speculum: quo IX. illius praecipuae nationes et populi, absque omni praeiudicio, ludibrio et opprobrio, saltem curiositatis et oblectationis gratia, certis characteribus et symbolis discernuntur, ob oculos positum).1 V naslovu je torej pojasnjen tudi razlog za nastanek teh tiskov, izšli so ≫zaradi radovednosti in zabave≪ (curiositatis et oblectationis gratia). Podobno kot ostale razpredelnice ljudstev ti bakrorezi niso bili mišljeni kot predstavitev realnih podob, temveč so bili namenjeni tudi zabavi. (shrink)

Tekst razvija idejo interpasivnosti, novega koncepta, oblikovanega po modelu interaktivnosti in ki pokriva vrsto pojavov, v katerih subjekt delegira svojo pasivnost in užitek na drugo osebo ali stvar. Izhodišče je tekst, ki gaje leta 1874 napisal Villiers de 1'Isle-Adam in ki nemara lahko velja za rojstno mesto te ideje. Ta tekst razvija pojem la claque, in predlaga njegovo razširitev, tako da bi ga pretvorili v mehanični aparat. Pričujoči tekst skuša pokazati, daje ta claque mogoče vzeti za vzorec za delovanje (...) želje in njene inherentne interaktivnosti, medtem ko leži ključ do interpasivnosti v neki dimenziji, ki se inherentno razlikuje od želje in seji zoperstavlja, in ki jo je Freud zakoličil kot nagon. Medtem ko se želja vzdržuje skozi svojo nenehno nezadovoljenost, pa je nagon vselej zadovoljen, subjektu priskrbi užitek, pred katerim ga želja skuša obvarovati. Psihoanalizo je tako mogoče dojeti kot proces, ki vodi od struktur želje k strukturam nagona. (shrink)

Josip Pipenbacher se je po maturi leta 1891 vpisal na študij klasične filologije na Dunaju; tu je leta 1895 doktoriral (v disertaciji se je ukvarjal s Ksenofontovim spisom Ustava Lakedajmoncev) in opravil profesorski izpit. Najprej je kot suplent poučeval na Državni c. kr. nižji gimnaziji v Ljubljani (zdaj gimnazija Poljane), nato kot profesor na Višji c. k. gimnaziji v Novem mestu in končno znova na Drugi c. kr. državni gimnaziji v Ljubljani; to je med letoma 1921 in 1928 (...) vodil kot direktor. Po ustanovitvi Univerze v Ljubljani je med letoma 1920 in 1939 kot honorarni predavatelj vodil latinske proseminarje in tečaje latinščine. Napisal je vrsto učnih pripomočkov, najbolj znani so latinska slovnica in štiri latinske vadnice, vse v več izdajah, sodeloval pa je tudi pri nastajanju Wiesthalerjevega Latinsko-slovenskega slovarja, za katerega je obdelal črko R. Bil je strog ocenjevalec, posebej odmevna je bila njegova ocena Latinske slovnice Josipa Tominška), napisal pa je tudi nekaj prispevkov s področja metodike pouka latinskega jezika. Kot šolnik se je vključeval v delo različnih društev in organizacij, vseskozi je finančno podpiral različna študentska, prosvetna in druga društva, nekaj časa pa je deloval tudi v lokalni politiki kot član ljubljanskega mestnega sveta. Zadnja leta svojega življenja je preživel na svojem posestvu v Sveti Marjeti na Dravskem polju. Umrl je 11. aprila 1949 v Mariboru. (shrink)

Knjiga, ki ji je posvečena pričujoča recenzija, prinaša prevod dveh krajših Bonaventurovih del, O trojni poti (De triplici via) in Kako se različne umetnosti zvajajo na teologijo (De reductione artium ad theologiam). Prevedla ju je filozofinja in klasična filologinja Nena Bobovnik, ki na KU Leuven pripravlja doktorat iz srednjeveške filozofije. Poleg spremne besede z naslovom »Zaris srednjeveške in skicaBonaventurove filozofije« sta še dva uvoda v piščevo misel. Najprej tri kateheze, ki jih je papež Benedikt XVI. – ki se je na (...) Bonaventurovo teologijo zgodovine osredotočil v habilitacijski nalogi – spomladi leta 2010 posvetil svojemu »prijatelju«, kot se sam izrazi; nato pa še esej »Teološko-filozofska hermenevtika pri sv. Bonaventuru in njen pomen za današnji čas«, ki ga je pripravil Branko Klun s Teološke fakultete UL. (shrink)

Spis z naslovom Knjiga Lucija Cecilija izpovedovalcu Donatu o smrtih preganjalcev (De mortibus persecutorum) je ohranjen v enem samem rokopisu iz 11. stoletja, odkritem leta 1778 v samostanski knjižnici v Moisacu. Ob prvi objavi (1779) ga je Etienne Baluze pripisal krščanskemu piscu in učitelju retorike Laktanciju (ok. 250–ok. 325), najbolj znanemu po prvi celoviti obravnavi krščanske vere, spisu Božji nauk (Divinae institutiones), a kmalu so se pojavili dvomi o njegovem avtorstvu. Tako po formi kot po obravnavani temi, strahotnih koncih (...) cesarjev preganjalcev, ki jih je Bog strogo kaznoval za njihove zločine, spis v antični književnosti nima prave primere. Zato je bil deležen različnih opredelitev kot krščanski pamflet, Konstantinov panegirik, konstantinska propaganda ipd. Forma je izrazito retorična, vsebuje tudi elemente krščanskega in poganskega zgodovinopisja in hagiografije, zgleduje se po judovski in antični tradiciji, v njem so opazne sorodnosti z Drugo knjigo Makabejcev in Konstantinovim govorom Oratio ad sanctorum coetum. Po vrsti razprav in člankov za in proti Laktancijevemu avtorstvu, ko se je zdelo že, da dvomov ni več, je leta 2013 izšla knjiga Jeana Rougeja in Daniela de Deckerja z obnovljeno tezo, da je spis služil konstantinski propagandi in je nastal na pobudo cesarja, podkrepljeno s temeljito študijo drugih Laktancijevih del, in argumenti, oprtimi tudi na izsledke računalniško pripravljenih analiz. V današnjih humanističnih vedah ne manjka sklicevanj na antropocen in ontološke premike, ki naj bi jih ta domnevno sprožil. Esej se osredotoči na več fiktivnih in kritičnih del – predvsem na roman Paula Bowlesa The Sheltering Sky iz leta 1949 – zato da bi podal vrsto trditev glede težavnosti predstavljanja razmerja med naravo kot področjem kavzalnosti, ki se podreja naravnim zakonom, na eni strani ter nominalno človeškim ali razumskim področjem, kamor sodijo dejanja, namere in različni upravičeni ali neupravičeni razlogi, (...) na drugi strani. Predvsem pa ga zanima raziskovanje želja, ki motivirajo prizadevanja po kontrastnih načinih reprezentiranja tega razmerja in na koncu vztraja na ključni vlogi reprezentacije, ki naredi upodabljanje takšnih dilem razumljivo, njihove predpostavke pa problematične. Matej Hriberšek z monografijo Slovenski doktorji klasične filologije na dunajski univerzi v obdobju 1872–1918 razširja in nadgrajuje raziskave, ki jih je izvedel za področje klasične filologije v sklopu projekta »Zgodovina doktorskih disertacij slovenskih kandidatov v avstro-ogrski monarhiji (1872–1918)«. Izbira letnic je logična: leta 1872 je v avstro-ogrski monarhiji prišlo do korenite reforme doktorskega študija (odtlej so doktorski kandidati morali pred promoviranjem napisati znanstveno disertacijo ter uspešno opraviti dva rigoroza), leto 1918 pa zaznamuje konec monarhije. Za to obdobje je na (...) dunajski Filozofski fakulteti evidentiranih 11 doktoratov s področja klasične filologije. Hriberškov pogoj za uvrstitev kandidata na seznam ni bil le, da slednji izvira s slovenskega narodnostnega ozemlja, ampak tudi, da je za materni jezik na vpisnici navedel slovenščino. Čeprav za dva kandidata (Janeza Maslja in Franca Omerzo) v arhivski dokumentaciji ni zapisa o promociji, sta v knjigo vseeno vključena, saj sta opravila vse oziroma večino obveznosti, ki so bile zanjo pogoj. Avtor se loteva postapartheidovskega branja »spomenika ženskam«, ki so ga leta 1913 odkrili v Južni Afriki. Oris družbene funkcije podobnih spomenikov služi, da bi poudarili estetsko ideologijo »Spomenika ženskam«. Avtor meni, da bi spomenik, takšnega kot je, lahko rehabilitirali v postapartheidovski družbi, če bi njegovo percepcijo dopolnjevalo širše poznavanje vojnega trpljenja. Spomenik bi lahko rekontekstualizirali tako, da bi omogočili slišanje drugih glasov, tj. glasov ženskih in črnskih žrtev davnega spopada med Buri in Britanci.
